Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of the Sendmux platform operated by Jonah and Associates Pty Ltd. This AUP is incorporated into and forms part of our Terms of Service. Capitalised terms not defined here have the meanings given in the Terms of Service.


1. General Principles

Sendmux is an email routing and orchestration platform. You are responsible for all email content routed through the Service, including emails sent by AI agents operating under your account. You must comply with all applicable laws and regulations in every jurisdiction where your emails are sent or received.

2. Prohibited Activities

You must not use the Service to:

2.1 Spam and Unsolicited Email

  • Send unsolicited bulk email without proper consent from recipients
  • Send email in violation of the Australian Spam Act 2003, CAN-SPAM Act, GDPR, PECR, CASL, or any other applicable anti-spam legislation
  • Harvest, scrape, or purchase email addresses for the purpose of sending unsolicited email
  • Fail to honour unsubscribe or opt-out requests within the legally required timeframe
  • Use misleading or deceptive subject lines or sender information

2.2 Malicious Content

  • Distribute malware, viruses, trojans, ransomware, or any other malicious software
  • Send phishing emails or emails designed to fraudulently obtain personal information, credentials, or financial details
  • Impersonate another person, organisation, or entity
  • Send emails containing links to malicious websites

2.3 Illegal Content

  • Distribute content that is illegal under Australian law or the laws of the recipient's jurisdiction
  • Facilitate or promote illegal activities
  • Distribute child sexual abuse material (we will report any such activity to relevant authorities immediately)
  • Infringe on the intellectual property rights of others

2.4 Harassment and Abuse

  • Send threatening, harassing, defamatory, or abusive emails
  • Target individuals or groups with hate speech or discrimination
  • Stalk or intimidate others via email

2.5 System Abuse

  • Attempt to gain unauthorised access to the Service, other accounts, or related systems
  • Interfere with the operation of the Service or its infrastructure
  • Circumvent rate limits, quota restrictions, or access controls
  • Use the Service to conduct denial-of-service attacks or similar actions against any target
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service
  • Share, resell, or redistribute access to your account without authorisation

2.6 AI Agent Misuse

  • Deploy AI agents with email access without appropriate permission tiers and monitoring
  • Allow AI agents to send email autonomously without adequate safeguards against prompt injection or other adversarial attacks
  • Use AI agents to circumvent sending limits, consent requirements, or other restrictions
  • Fail to maintain audit trails for AI agent email activity

3. Default Sending Account

The default sending account provided to new tenants is subject to additional restrictions:

  • Maximum sending volume as published in our documentation
  • Content must comply with the sending provider's acceptable use policies
  • We may suspend default account access at any time for abuse, without prior notice
  • Continued misuse of the default account may result in account termination

4. Email Authentication

You must properly configure email authentication (SPF, DKIM, DMARC) for any custom domains used with the Service. Failure to maintain proper authentication may result in degraded deliverability and is considered a violation of this AUP if it affects the Service's shared infrastructure reputation.

5. Reporting Abuse

If you become aware of any violation of this AUP, please report it to contact@sendmux.ai. We investigate all reports and take appropriate action.

6. Enforcement

6.1 Actions We May Take

If we determine that you have violated this AUP, we may take one or more of the following actions at our sole discretion:

  • Issue a warning
  • Throttle or rate-limit your sending
  • Suspend access to the default sending account
  • Temporarily suspend your account
  • Permanently terminate your account
  • Report illegal activity to relevant authorities

6.2 Process

For non-urgent violations, we will typically notify you and provide an opportunity to remedy the violation before taking enforcement action. For severe violations (such as phishing, malware distribution, or illegal content), we may take immediate action without prior notice.

6.3 Appeals

If you believe enforcement action was taken in error, you may contact us at contact@sendmux.ai to request a review.

7. Changes to This Policy

We may update this AUP from time to time. We will notify you of material changes through the Service or by email. Continued use of the Service after changes take effect constitutes acceptance.
